WHY THE NEED FOR TRAINING?

The Health and Safety at Work Act 1974 (also referred to as HASWA) is the primary piece of legislation covering occupational health and safety in Great Britain. The Health and Safety Executive (HSE), with local authorities is responsible for enforcing the Act and several other Acts and strategy instruments relevant to the working environment.

THE MANAGEMENT OF HEALTH AND SAFETY AT WORK REGULATIONS

The Management of Health and Safety at Work Regulations requires employers to put in place arrangements to control health and safety risks. As a minimum,employers should have the processes and procedures needed to meet the legal requirements including risk assessments, method statements, toolbox talks and permits to work. Where possible these should be documented and recorded.

PROVISION AND USE OF WORK EQUIPMENT REGULATIONS (PUWER)

The PUWER regulations state that “Every employer shall ensure that all persons who use work equipment have received adequate training for purposes of health and safety, including training in the methods which may be adopted when using the work equipment”

“Every employer shall ensure that any of their employees who supervises or manages the use of work equipment has received adequate training for purposes of health and safety, including training in the methods which may be adopted when using the work equipment, any risks which such use may entail and precautions to be taken.”

Employers are also required to provide refresher training as and when necessary, for example after an extended period of absence from work, when someone infrequently deputises for others or whensomeone moves to another role involving the use of different work equipment. All training records should be available for HSE inspections.
